Purchase Contract / Health Guarantee
BY PLACING A DEPOSIT OR PURCHASING A DOG FROM
JILLYBEAN’S SHIH TZU SHOPPE YOU HAVE AGREED TO THE
TERMS AND CONDITIONS OF THIS CONTRACT AND UNDERSTAND
THAT THE AGREEMENT IS LEGAL AND BINDING.
The purchase price of puppy is $________ with _LIMITED_ Registration as defined by the AKC (American Kennel Club). Shipping charges are not included in purchase price. Monies are Non-Refundable. Registration fees are the sole responsibility of the buyer. Puppy Sold with Limited Registration must be Spayed or Neutered by 7 months of age. This is part of Your Contract: Veterinary proof of Spay / Neuter must be given regardless of whether you want your puppy AKC Registration Papers or Not. AKC Registration papers, if desired by buyer, will then be released.
As of the date of delivery, the puppy has received proper vaccinations and de-worming and buyer has been informed of these. To the best of the seller's knowledge and belief, this puppy is in good sound health, free from symptoms of contagious and infectious diseases at the time of sale and should be Vet checked within 72 hours of receiving said puppy. A copy of the exam must be mailed to Seller promptly, if Vet Check is not performed, health guarantee is Null and Void. If the buyer believes this puppy to be sick, the animal should be immediately taken to a veterinarian of the buyer's choice. Breeder cannot guarantee health beyond the 72 hour period since proper care and nutrition is outside of the breeder’s control once puppy has been picked up or shipped.
A one year after sale Replacement Guarantee is given for any proven congenital disease not common to the brachycephalic breeds that caused your puppy to expire. A notarized Veterinarian Report with findings stating, to a medical certainty (Full Autopsy), that the death was definitely caused from the prenatal state will be required. Buyers will be required to send the notarized Vet's Report by registered mail along with all of the puppy's medical records immediately. Sellers Veterinarian must confirm and agree with the diagnosis. The Seller will then give buyer a replacement puppy of equal value and the same gender, from the next available litter. Seller reserves the right to a possible waiting time of one (1) year to make this replacement, as puppies are not available at all times. The guarantee does not cover neglect or improper care by the buyer(s).
This guarantee does not include giardia, coccidia and kennel cough which is usually caused by bacteria and is common in puppies that are shipped. This guarantee does not cover that which we commonly see in the Shih-Tzu breed: dry eye, cherry eye, pinched nostrils / stenotic nares, reverse sneezing and both inguinal and umbilical hernias. (Most hernias can be fixed easily when puppy gets spayed / neutered.) Hernias must be certified by a veterinarian, to be currently life threatening and to have rendered the puppy unfit for purchase, in order for surgical repair reimbursement consideration. After receiving certification as to this condition by a qualified veterinarian. Seller reserves the right to directly discuss this issue with the certifying veterinarian and / or allow the seller’s veterinarian to communicate with the certifying veterinarian. Seller also reserves the right to determine the appropriate reimbursement amount. Heart, Kidney, and Liver are the ONLY conditions that are covered by this contract.
We guarantee parvovirus and distemper ONLY if medically documented and we are contacted within the first 7 days because the puppy can get this disease after it departs our home. Diagnosis and lab results must be provided immediately to JillyBean’s Shih Tzu Shoppe.
JillyBean’s Shih Tzu Shoppe is not responsible for any vet or medical bills that are incurred by the said puppy from the date the said puppy leaves with its new owner. It is the sole responsibility of the new puppy owner to treat the puppy for all and any medical health conditions that arise from the date the said puppy is in the care of the new owner and thereafter. Once said dog has left the home of JillyBean’s Shih Tzu Shoppe, JillyBean’s Shih Tzu Shoppe is not responsible for any infection, allergies, illness or behavioral problems that may occur.
JillyBean’s Shih Tzu Shoppe does not guarantee hypoglycemia (this is up to the New Owner to prevent). If you are going to become a toy dog owner you will want to know the symptoms of hypoglycemia. Hypoglycemia is often seen in young toy puppies and most of the time the symptoms can be controlled by eating or giving some glucose such as Nutri-Cal or White Karo Syrup to the puppy. Glucose is what the body uses as fuel and is necessary for the brain tissue and muscles to function. It can cause your puppy to become confused, disoriented, drowsy, have the shivers, stagger about, collapse, fall into a coma, or have seizures. Episodes of hypoglycemia often occur without warning. A puppy may be stressed by shipping, or a missed meal, being chilled, or even exhausted from playing too much. Because of their tiny size, toy puppies cannot eat a lot at one time and run out of fuel quickly. Puppies should be fed several times a day a high quality diet. Most puppies will outgrow this issue. Some very tiny dogs will continue to have bouts of hypoglycemia throughout their life. If your puppy experiences episodes of hypoglycemia it is important to restore the blood levels of glucose as quickly as possible.
The seller will assume no shipping costs associated with sale or Replacement Warranty. The seller assumes no responsibility for medical expenses, mortality, landlord’s disapproval, allergy, or any other undesirable circumstances once the dog has left the seller’s premises.
The size a puppy will grow to as an adult is only an estimate, No Guarantees are made as to adult size. Prices are based on quality, pedigree, size, color, and sex. The seller does not guarantee the color of these dogs as this breed is usually double coated their color may become lighter or darker as they age and grow and will almost always be lighter if you have the dog shaved down as the undercoat is lighter. All colors & sizes stated are estimates only.
Buyer agrees that puppy /dog will live inside the Buyer’s home and will not be housed outside for any length of time. Buyer agrees that puppy / dog will be socialized and treated as part of the family.
Buyer agrees that the puppy will never be placed in a shelter, pound, or sold to a broker, pet shop, or puppy mill. If for any reason buyer(s) are unable to keep or care for this puppy/dog at any time during its life, buyer(s) must surrender the puppy/dog to the seller with all registration documents and medical records, etc. at no compensation to the buyer (unless prior arrangements are made). Buyer(s) agrees not to sell or give the puppy/dog away to anyone else under any circumstances! We do NOT want to see any of our babies in undesirable circumstances!
Any disputes will be litigated in St. Johns Count, Florida, USA at the buyer's expense.
Warranty applies to the original buyer only, and is not transferable if puppy is rehomed or resold.
